General Sales Terms and Conditions

Amiral M.S. is a company specializing in the manufacture and sale of model ship products, wooden model boats and decorative objects.

These conditions of sale are written in English and French, and only these two languages guarantee the accuracy of the translation for the proper understanding of these conditions. If you use a translator for any other language, please ensure that the translation is correct. These general terms and conditions of sale are entered into on the one hand by the sole proprietorship of Mr BERTRAND Alain, under the brand name "Amiral M.S.", whose registered office is located at 200 rue de la Croix Nivert, 75015 Paris, registered with the Registre National Des Entreprises under the number 49202341100076, hereinafter referred to as "AmirAl M.S." and managed by Mr BERTRAND Alain, and on the other hand by any individual or legal entity wishing to make a purchase via the website https://www.amiral-ms.com, hereinafter referred to as "the buyer".

Article 1. Purpose

The present conditions of sale aim to define the contractual relationship between Amiral M.S. and the buyer, and the conditions applicable to all purchases made through the https://www.amiral-ms.com website. The acquisition of a product through this site implies unreserved acceptance by the purchaser of these conditions of sale, which the purchaser acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products on the https://www.amiral-ms.com website is not directly related to their professional activity and is limited to strictly personal use, and on the other hand that they have full legal capacity, enabling them to commit to the present terms and conditions of sale.

The company Amiral M.S. reserves the right to modify these Terms of Sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Consequently, the applicable terms and conditions will be those in force at the date of the buyer's order.

Article 2 — Products

The products offered are those shown on the website https://www.amiral-ms.com operated by the company Amiral M.S., while stocks last. The company Amiral M.S. reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics (dimensions, use, materials, etc.). The photographs are as accurate as possible, but are not binding on the Vendor. In particular, photos of wooden objects (figureheads, decorations, etc.) are not contractual, given that each piece of wood is unique in its nuances of shade and grain. The sale of products presented on the website https://www.amiral-ms.com is intended for all buyers residing in countries that fully authorize the entry of these products into their territory. (See article 8.2 for countries excluded by government restrictions).

Article 3 — Prices and delivery charges

The prices shown on the product sheets of the internet catalog are Net prices in Euros (€), VAT not applicable according to the article 293B of the CGI, so there is no VAT to add.

The company Amiral M.S. reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, according to the total amount of the order. In mainland France, for all orders (excluding reduced models) of 500 euros or more, shipping costs are free; for all orders of less than 500 euros, the buyer will be charged a flat-rate contribution to shipping costs in France of 10 euros (including VAT), or the amount indicated at the time of order.

For France overseas, the buyer will be charged a flat-rate contribution to shipping costs of 15 euros including VAT, or the amount indicated at the time of order.

For countries within the European Union, the buyer will be charged a flat-rate shipping fee of 20 euros, including VAT, or the amount indicated at the time of order.

For all deliveries outside the European Union, a flat-rate contribution to shipping costs will be invoiced to the purchaser in the amount of 30 euros including VAT, or the amount indicated at the time of order. Please note that although there is no French VAT tax, each country may apply customs duties which will be charged to the buyer.

Article 4 — Orders and payment

Before placing an order, the buyer has the option to create an account on the website https://www.amiral-ms.com, but this is not a requirement for placing an order. The account creation section can be accessed directly from the top menu. Each time you visit the site, if you wish to place an order or consult your account (order status, profile, etc.), you must identify yourself using this information. The price is payable at the time of order. The company Amiral M.S. offers the buyer the option of ordering and paying for its products in several stages, with 2 payment options to choose from:

- Secure payment by PayPal (via the PAYPAL system): the buyer selects the products they wish to order in the "basket", modifies the quantities and references if necessary, checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: "Payment by PayPal". In the next step, the buyer is asked to check all the information, to read and accept the present terms and conditions of sale by ticking the appropriate box, and then to confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the PAYPAL secure interface, where they can enter their PayPal account details in a secure environment. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by PayPal account is irrevocable. In the event of fraudulent use of the account, the purchaser may demand cancellation of the payment, in which case the sums paid will be credited back or refunded. To obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the PayPal account holder must dispute the debit in writing with his or her account within 70 days of the transaction, or 120 days if provided for in the contract. The amounts debited will be reimbursed by the bank within one month of receipt of the account holder's written objection. The cardholder will not be charged for the return of the sums.

- Payment by bank transfer: the buyer selects the products he wishes to order in the "shopping basket", modifies the quantities and references if necessary, checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: "Bank transfer". In the last step, the buyer is asked to check all the information, to read and accept the present terms and conditions of sale by ticking the appropriate box, and then to confirm the order by clicking on the "Confirm my order" button. This last click constitutes the definitive conclusion of the contract. As soon as the order has been validated, the buyer receives an order form confirming that the order has been registered. In order to finalize payment and process the order, the buyer must contact his bank to transfer the amount of his order to the bank account of the company Amiral M.S., whose details are communicated to the buyer. As soon as the transfer is received, the order will be processed and the buyer will be informed by e-mail. The company Amiral M.S. will ship the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to provisions.

Confirmation of an order implies acceptance of these terms and conditions of sale (which include the general terms and conditions of use), acknowledgement of full knowledge thereof and waiver of the right to invoke one's own terms and conditions of purchase. All data supplied and the recorded confirmation shall be deemed proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, Amiral M.S. will send confirmation of the order by e-mail.

Article 5 — Retention of title

The company Amiral M.S. retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.

Article 6 — Right of withdrawal

In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery date of their order to exercise their right of withdrawal and return the product to the seller for exchange. The product must be returned in its original packaging, with the same precautions taken. Shipping costs for the return of the product are at the customer's expense, and must be standard delivery service and not economy delivery service. After reception and control of the returned product, a credit note will be sent by email to the customer with a security code. The credit note must be used within a maximum of 3 months (from the date of receipt of the item by our company). This will enable the customer to benefit from a discount of the amount of the credit note on the purchase of a new article. If the price is higher, you'll have to pay the rest of the cost; if it's equal to your returned item, you'll only have to pay the delivery costs of the new item. If the amount of your new item with delivery charges is equal to your credit note, you will not have to make any payment. If the amount of your new order with delivery charges is less than the credit note, the difference will be the subject of a new and final credit note (concerning the same return), also to be used within 3 months. No reimbursement will be made other than by this method.

Article 7 — Return policy

Return of a product damaged in transit

Amiral M.S. pays particular attention to both the quality of its products and the quality of its packaging. The latter is specially designed to protect the product from breakage in extreme situations. It is therefore highly unlikely that the product will break during delivery.

However, if you notice that the packaging is damaged, take photos of the package before opening it. If the product inside is damaged or broken, also take photos showing the breakage or damage. If you wish to make a complaint about a product damaged by delivery, you must fill in the downloadable form available on this site, and send this document by e-mail to the contact address, together with legible, good-quality photos. The request will be processed within 2 working days, and you will receive an e-mail confirming that your request has been taken into account.

After checking and validating your details, you will receive another e-mail confirming the exchange of your item. The product must be returned in its original packaging, with every precaution taken to ensure that the item is preserved in the same condition as when you received it. Shipping costs for the return of the product are at the customer's expense, in standard delivery and not in economy service. On receipt of your parcel, after checking that the item matches your photos, you will be sent a new identical item free of charge within a maximum of 3 working days.

Customized items

Est défini comme article personnalisé, toute fabrication spécialement réalisée sur commande, ou un produit standard stocké qui aurait été modifié ou agrémenté selon la demande du client. Les articles personnalisés, ainsi que les produits avec une remise spéciale (produit avec défaut apparent, vendu en l'état) ne sont ni repris ni échangés, ni garantis hormis selon les conditions de l'article 7 des présentes CGV.

Article 8.1 — Livraison

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are handled by La Poste or any other carrier, according to the indications and options you choose when placing your order. If delivery times exceed thirty (30) days from the date of order, the sales contract may be cancelled at the written request of the purchaser (to the e-mail address amiral.ms2025@gmail.com, or by post to the following postal address: Amiral M.S.- 200 rue de La Croix Nivert 75015 Paris - France). It will be reimbursed in the form of a credit note for a new purchase on the https://www.amiral-ms.com website.

The company Amiral M.S. can provide the buyer with the tracking number of his parcel by e-mail if they have taken this option. The buyer is delivered to their home by their local carrier. If the purchaser is absent, they will receive a delivery notice from the letter carrier, allowing them to collect the products ordered from the nearest post office, within a period of time indicated by the postal services. The buyer is obliged to check the condition of the packaging and the contents of the goods on delivery in the presence of the Post Office employee or the delivery person (see article 7 of the General Terms and Conditions). In the event of damage in transit, any protest must be made to the carrier within three days of delivery.

The customer is responsible for the accuracy of the address given at the time of ordering and undertakes to provide an accurate and complete address. If a parcel cannot be delivered and is returned to the sender due to an incorrect or incomplete address, the customer will be required to pay a new delivery charge for the reshipment of the parcel.

Article 8.2 — Geographical restrictions

Below are the countries subject to EU sanctions, according to the January 2025 government website (douane.gouv.fr).

In view of these restrictions, the website will normally not validate your order if you are in one of these countries.

Article 9.1 — Warranty

All products supplied by the company Amiral M.S. are subject to the legal warranty provided by articles 1641 to 1649 of the French Civil Code.

If the product does not correspond to the order, it can be returned to the company Amiral M.S. who will take it back, exchange it or make a credit note to be used within 3 months (from the date of receipt of the returned part), see return conditions article 6 and 7 of the GCS.

Vice caché (Article 1642 et 1643 du code civil) pour les produits en bois massif

To be used in the manufacture of objects such as figureheads, decorations, etc., wood must reach a specific moisture content of between 8% and 12%. However, even at this level, it continues to react to variations in ambient humidity, contracting or expanding slightly, and even showing small cracks. For example, the average humidity in our homes is lower in winter (30 to 40%) than in summer (50 to 60%), so an object will be slightly wider in winter than in summer. Wood remains dynamic and sensitive to its environment. It is also your responsibility not to expose the object to excessive heat or humidity.

Every piece of wood is different, and the grain and color can vary from one piece to another, especially certain species such as Boxwood and Pearwood. Product photos are not necessarily contractual. If the appearance of the product shows strong veining or variations in shade, I can send you photos of the product to validate your choice.

It should also be noted that the color of wood can change over time, or depending on the finishing treatment you apply. Any variations, small cracks or changes in shade are therefore not considered hidden defects.

Article 9.2 — Warranty exclusions

According to the above, solid wood items are therefore not guaranteed, except under the conditions described in article 7 of these GCS.

Article 10 — Liability

The company Amiral M.S., in the process of distance selling, is only bound by an obligation of means. It may not be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.

Article 11 — Intellectual property

All elements of the website https://www.amiral-ms.com are and remain the exclusive intellectual property of the company Amiral M.S. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.

Article 12 — Settlement of disputes

These conditions of distance selling are governed by French law. For all disputes or litigation, you will find information on the official French Public Service website Achat à distance, e-commerce : démarches et recours en cas de litige | Service-Public.fr.
